General Conditions

Welcome to www.uvethc.com, the Uvet Hotel Company service that allows you to book and purchase accommodation services at our holiday facilities. Uvet Hotel Company is part of the Uvet Group, a leader in the travel and tourism industry, which records an annual turnover of approximately 2.5 billion Euros. We invite you to carefully read the terms and conditions that follow and that govern our services. Uvet Hotel Company reserves the right to change the terms and conditions without notice, when such changes become necessary due to changes in the market, regulatory changes or changes in the provision of the services. In any case, the use of the Website and its freely accessible functions implies acceptance of these general conditions. These General Contract Conditions govern the purchase of vacation services remotely, via computer network, on the Website www.uvethc.com, and the related contract entered into Uvet Hotel Company and site users. Each purchase transaction will be governed by the provisions of Articles 50 – 68 of Legislative Decree no. 206 of 6 September, 2005, “Consumer Code”, as amended, which pertains to contracts executed remotely. Without prejudice to the possibility of entering into dedicated agreements, where possible, notwithstanding these general terms and conditions.

1. Acceptance of the General Conditions of Sale.

By sending the electronic confirmation of his/her purchase order, the Customer unconditionally accepts and undertakes to comply with these general conditions, declaring that he/she has read and accepted all the information provided to him/her pursuant to the aforementioned rules, also acknowledging that Uvet Hotel Company shall not accept different conditions unless previously agreed in writing. Any voidance or the full or partial non-validity of one or more articles of these General Conditions does not in any way affect the validity of the other articles contained in the contract, which are to be considered valid and effective without restrictions. Another provision will be applied in lieu of the non-valid or ineffective conditions, which proves appropriate for the economic purposes set forth in the contract.

2. Customer’s Obligations

These General Conditions of Sale must be reviewed online by customers of the www.uvethc.com site before they confirm their booking. The submission of the order confirmation therefore implies full knowledge of these General Conditions of Sale and full acceptance thereof.

Once the online purchase procedure has been completed, the Customer undertakes to print and keep these General Conditions of Sale, already viewed and accepted during the booking process, in order to fully meet the requirement set forth in Articles 52 and 53 of Legislative Decree no. 206/2005

To purchase Uvet Hotel Company accommodation services, you must be at least 18 years old or be of legal age according to the laws of the country of which you are a citizen. Any duly completed bookings, even if made by minors, or persons who are unauthorised to do so for any reason whatsoever, is considered to have full legal validity.

3. Methods of purchase

The purchase of hospitality services on www.uvethc.com is made by the Customer at the total price provided thereon, which is accepted at the time the booking confirmation is sent;

Before confirming the booking, the Customer is provided with a summary of the total cost of the vacation services requested

After confirming the reservation and paying the total amount indicated in the service summary, the Customer will receive an e-mail message at the address provided, containing the summary of his/her order, the reservation number, the service specifications and the cancellation terms

Under any circumstance, the booking confirmation is contingent upon receipt of the relative payment by Uvet Hotel Company

N.B.

The booking summary must be carefully reviewed before proceeding with payment. This is essential to ensure that all data (dates, times, guest names and addresses) are accurate. If any inaccuracy is identified, (e.g., spelling error) resulting from the customer’s inaccurate data entry, Uvet Hotel Company must be contacted immediately. In any case of charge-back, cancellation, and non-receipt of the price of the booked service, or if there are reasonable reasons to believe that the booking is fraudulent, Uvet Hotel Company reserves the right to cancel the booking or request payment of its equivalent value. If it proves impossible to contact the customer, Uvet Hotel Company may not confirm or may cancel the reservation without incurring any liability in this regard.

4. Contract stipulation

The contract is considered to have been entered into upon acceptance of the reservation by Uvet Hotel Company. At the same time, the Customer is required to pay the total amount detailed in the summary of the service booking by credit card, bank transfer or other means. In any case, the booking confirmation commits Uvet Hotel Company only to keep the reservation for the time necessary to receive proof of payment from the Customer. Upon successful completion of the payment, the reservation is considered to be definitively confirmed. If no payment is received, the Customer will not be entitled to keep the reservation.

5. Exclusion of the right of withdrawal

Pursuant to Art. 47 of Italian Legislative Decree n0. 206 of 6 September, as amended, namely, the “Consumer Code”, expressly excludes the applicability of the provisions to contracts entered into in non-business premises and online, and of the related right of withdrawal from contracts falling within the scope of application of the regulations concerning travel, holidays and “all inclusive” circuits, pursuant to Articles 32 to 51 of Legislative Decree no. 79 of 23 May, 2011, and to passenger transport service contracts. Consequently, the right of withdrawal does not apply to purchases made on www.uvethc.com.

6. Penalty for cancellation or early departure

In case of cancellation of the reservation by the Customer, Uvet Hotel Company has the right to apply as compensation, the following penalties to be calculated on the total price of the reservation:

  • cancellation received up to 15 days prior to the arrival date: 10% penalty
  • cancellation received up to working 3 days (Saturday excluded) prior to the arrival date: 30% penalty
  • cancellation received within 3 days prior to arrival or failure to cancel (no show): 100 % penalty

In the event of early departure, the hotelier has the right to request payment for the entire booked period, by billing all days/nights left in the reservation.

7. Beginning and end of stay

In general, in all hotels, the rooms are available from 2:00 pm on the day of arrival and must be vacated by 10:00 am on the day of departure. Any early accommodation or the release of the room after the indicated time are subject to the payment of a supplement on site, upon confirmation by the hotel. Customers who have booked half board accommodation are entitled to breakfast and dinner. For full board customers, the service usually begins with dinner on the first day of arrival and ends with lunch on the last day of vacation. It is not possible to receive discounts or rebates for meals included and not used for any reason.

8. Requests at booking

Any preferences stated by customers regarding the choice of rooms (e.g., on the ground floor, with double beds, …) are not binding for Uvet Hotel Company, which may or may not honour them, depending upon availability.

9. Guest rights

Guests whose reservation has been duly confirmed, have the right to use the premises of the hotel facilities, made available to guests without specific conditions, and all included services. Guests have the right to exercise their rights in compliance with all directives and regulations of the facility.

10. Guests’ Obligations

At check-out time at the latest, guests are required to pay any outstanding amount that may have accrued for extra services used by them, increased VAT and tourist tax, as applicable. The guests are also responsible for any damage suffered by Uvet Hotel Company or third parties, including by other guests, caused by them or by persons under their care.

11. Hotel’s rights

If any guest refuses to pay for any additional services purchased on site, the hotel is entitled by law to take possession of and retain the guest’s belongings that are in the hotel. These retention rights are also applicable as guarantee for indemnity of any kind.

12. Hotel’s obligations

The hotel is required to provide the services in a manner consistent with its standards. The Hotel can provide guests with adequate replacement accommodation (of similar quality), in the event of, by way of example, unusable room(s), extended stay of guests occupying the room in question, overbooking or other relevant needs of the hotel. Any additional costs associated with the replacement accommodation are the responsibility of the hotel.

13. Liability for damages to things

Uvet Hotel Company is responsible for any damage suffered by guests if such damage occurred on the hotel premises or have been caused by the hotel and/or its employees. Uvet Hotel Company is liable for things brought into the premises by guests up to a maximum amount equivalent to one hundred times the room price per day if and inasmuch as it fails to prove that the damage was not caused by it, its employees or by people who use its premises. In this context, the Company is liable, up to the aforementioned ceiling, for the deterioration, destruction or theft of things, valuables, money and debt instruments. For double rooms, if there is only one injured party, the compensation ceiling will be equal to one hundred times half the price of the room. However, Uvet Hotel Company is not liable when the damage or theft was caused by the Customer, by force majeure or the nature of the thing. The custody of objects can be denied if they are deemed to be dangerous (i.e., potentially capable of causing damage), too bulky or of excessive value. Things are considered to have been introduced into the facility when they are taken over by a member of the hotel staff or are taken to a place within the accommodation facility intended for their custody. The guest must report the fact without unjustified delay to the hotel management, in order not to lose the right to compensation (Article 1785-ter of the Italian Civil Code).

14. Maintenance

Uvet Hotel Company reserves the right to make changes to the organisation and facilities during the period in which it is open to the public. In order to ensure the conduct of necessary maintenance activities, the Customer agrees, without claiming any refund in this regard, that work may need to be performed in the room or any of the hotel facilities during the period of his/her stay in the hotel.

15. Animals

Animals are not allowed on any of the hotel premises.

16. Extension of stay

Guests cannot expect that any request for vacation extension will be honoured by the hotel. If a guest cannot leave the hotel on the expected departure date since, due to extraordinary and unforeseeable circumstances (e.g., natural disasters, floods, strikes, etc.) all possibilities to travel are precluded, the vacation contract will be automatically extended for the entire duration of the impediment. In such cases, Uvet Hotel Company is authorised to request as consideration at least the price charged in the low season.

17. Contract termination – Supervening impediment

Uvet Hotel Company may terminate the contract with immediate effect in the event that the guest:

uses the premises in a manner deemed to be severely prejudicial to the property or makes the coexistence with other guests intolerable by behaving in an arrogant, disrespectful, scandalous or reckless manner, or is guilty of actions or omissions against the service provider, the staff, other guests and/or people who are in the hotel, which are punished by law as a crime and concern property rights, morality and physical integrity

in the event that he/she suffers from a contagious disease or illness whose course exceeds the agreed period of stay or in the event that special care is required

If contract fulfilment is precluded due to force majeure events (e.g., natural disaster, strike, lockout, official provisions, etc.), Uvet Hotel Company may terminate the contract at any time without notice, if the contract is not already intended to have been terminated by effect of the law, or the hotel has not already been released from its obligation. Any right to compensation for damages and other reasons by Uvet Hotel Company is excluded.

18. Complaints

If the guest determines that a complaint must be lodged concerning his/her stay, the reasons for such complaint must be provided on site, directly to hotel management. If a guest is not satisfied with the way in which a complaint is processed, he/she has 10 days after departure to submit a written complaint, with a detailed explanation of its reasons.

19. Governing Law and jurisdiction

These terms and conditions, as well as the relationships between users and Uvet Hotel Company are governed by Italian law. The settlement of any dispute that may arise between customers and Uvet Hotel Company will be under the exclusive jurisdiction of the Court of Milan. “Mandatory communication pursuant to Article 17 of Law no. 38/2006 – The Italian law punishes crimes relating to prostitution and child pornography with imprisonment, even if committed abroad”.
